These terms are in two parts. Part A (Website Terms of Use) applies to anyone browsing safetycheckpro.com.au. Part B (Terms of Service) applies once you create an account or subscribe to the Safety Check Pro apps or web dashboard, and governs your use of the service. If you only browse the website, Part A is the only part that applies to you.
These terms cover your use of the Safety Check Pro apps (iOS and Android) and the web dashboard (“the service”). By creating an account or subscribing, you agree to them.
This Part A governs your use of the website at safetycheckpro.com.au (the “Website”), including its content, features, support and contact pages. It applies whether or not you create an account. If you use the Safety Check Pro app or web dashboard, Part B (Terms of Service) also applies to that use, and to the extent of any inconsistency about the app or dashboard, Part B prevails.
The Website is provided for general information about Safety Check Pro. Nothing on the Website is professional, trade, compliance or legal advice, and we do not warrant that it is complete, current or error-free.
All content on the Website, including text, graphics, logos and the Safety Check Pro name and branding, is owned by or licensed to us and protected by intellectual property laws. You may view and print pages for your own personal or internal business use. You must not otherwise reproduce, modify, distribute or create derivative works from Website content without our prior written consent.
You must not use the Website to:
The Website may link to third-party sites, including the Apple App Store and Google Play. We do not endorse, and are not responsible for the content or practices of, those sites.
We may change, suspend or discontinue any part of the Website at any time without notice.
This Part A is governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and courts competent to hear appeals from those courts.
You must be at least 18 years old to create an account. If you create or administer a team or business account, you warrant that you have authority to bind that business to these terms, to add and remove seat-holders, and that you will ensure each seat-holder complies with these terms.
Safety Check Pro lets tradespeople and inspectors record inspections, build custom forms, generate PDF reports, and sync their work across devices and a team. We add, change and occasionally retire features as the product evolves.
New accounts get a 30-day free trial with no payment details required. When the trial ends, creating new reports requires a subscription; everything you have already created stays readable and exportable.
Subject to your ongoing compliance with these terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable licence to access and use the app and web dashboard for your own business purposes, for the term of your subscription. All intellectual property rights in the app, the web dashboard, our underlying software, and our built-in checklists and report templates belong to us or our licensors. This licence does not extend to your report content, which remains yours (see “Your data” below). You must not copy, reverse-engineer, resell, sub-license or create derivative products from the service or our templates, except as this licence expressly allows.
If we change prices, existing subscribers get at least 30 days' notice by email or in-app message before the new price applies at their next renewal.
Amounts already paid are generally not refundable for a part-used billing period, except where the Australian Consumer Law or another law requires otherwise. Nothing in these terms limits your rights under the Australian Consumer Law.
Safety Check Pro records and presents the information you enter. It does not perform inspections, verify your findings, or provide trade, legal or compliance advice. The app is a record-keeping and reporting tool only. It is not a regulatory document or authority, and reports produced with it are not issued, approved or endorsed by any government body or standards authority.
You (or the licensed person carrying out the work) remain solely responsible for holding the licences and registrations required for your work, for knowing and applying the standards and regulations that apply to each check in your state or territory, for conducting inspections competently, and for the accuracy of what is recorded. Checklists and references to standards within the app are provided as a convenience only and are not a substitute for the current standards, regulations or your own professional judgement. A report generated by the app is your report, not ours.
You must actively acknowledge these responsibilities in the app before you can generate a report. The app will not allow you to generate a report until you have done so, and we may require you to re-acknowledge this section if we materially update it.
Reports generated using the service are prepared by you (or your business), using information you enter, and are your reports, not ours. We do not review, verify, approve or endorse the content of any report. A report is prepared only for the customer who commissioned the relevant work, and only for the purpose for which it was prepared. In particular, a report is not addressed to, and must not be relied on by, any subsequent property owner, tenant, purchaser, financier, insurer or regulator as a substitute for their own professional advice or independent verification.
To the maximum extent permitted by law, we owe no duty of care to, and accept no liability to, any person other than you (or your business, if you hold a business account) arising out of or in connection with the content of a report or its use by a third party. You must not remove, obscure or alter any disclaimer that appears on a report generated by the app.
You warrant that: you own or hold all necessary rights, consents and licences for the content you upload or enter into the app (including customer information, photos, logos and any other material); your use of the service, and every report you produce, complies with all laws, licensing requirements and professional obligations that apply to you; and, if you hold a business or team account, you have the authority described under “Eligibility and authority” above.
You indemnify us against any loss, damage, cost or claim (including reasonable legal costs) that we suffer or incur arising from your breach of these warranties, your use of the service, or a report you produce, except to the extent caused by our own negligence or breach of these terms. This indemnity survives termination of these terms.
If your account is terminated (by you or by us) or placed into indefinite suspension, we will give you at least 30 days' notice before deleting your account data, together with instructions on how to export a copy of it. Subject to that notice, we may delete your account data (including report content) at the earlier of: (a) 7 years after it was created; or (b) 12 months after your account is terminated or placed into indefinite suspension. We may retain data for longer where required by law or to resolve a dispute. If you close a team or business account, this clause applies to the shared business data as a whole, and you are responsible for telling your team members before you do so.
The apps are built to work offline, and we work to keep the sync and dashboard services available, but we cannot promise uninterrupted or error-free operation. Planned changes that materially affect the service will be flagged in release notes.
Neither party is liable for a delay or failure to perform an obligation under these terms (other than an obligation to pay money) to the extent the delay or failure is caused by circumstances beyond that party's reasonable control, including natural disaster, war, civil unrest, internet or telecommunications failures, or the failure of a third-party platform we rely on, such as a cloud hosting or app store provider.
To the extent permitted by law, our total liability for any claim connected with the service is limited to re-supplying the service or refunding the fees you paid in the 12 months before the claim. We are not liable for indirect or consequential loss, including loss arising from the content of inspections and reports, which remains your professional responsibility. Nothing in this section excludes consumer guarantees or other rights that cannot be excluded under the Australian Consumer Law. This limitation is in addition to, and does not narrow, the disclaimers set out in “Reliance on reports” above.
The Operator enters into these terms only in its capacity as trustee of the Expedite Electrical Discretionary Trust (Trust), and in no other capacity. The Operator's liability arising under or in connection with these terms is limited to, and can only be satisfied out of, the assets of the Trust from which the Operator is actually and validly indemnified for that liability. This limitation does not apply to the extent the Operator is not entitled to be indemnified out of the Trust's assets because of its own fraud, wilful misconduct or gross negligence. This clause survives termination of these terms.
You can stop using the service and cancel at any time. We may suspend or close accounts that breach these terms or remain unpaid, after reasonable notice where practical. If we ever discontinue the service, we will give at least 60 days' notice so you can export your reports.
We may update these terms as the service evolves; the “last updated” date will change. If a change is material, for example if it reduces your rights or increases your obligations, we will give existing subscribers at least 30 days' notice (or, if your billing cycle is longer than 30 days, notice before your next renewal) by email or in-app message before it takes effect. Other changes, such as minor, procedural or legally required updates, may take effect immediately. If you don't agree with a material change, you may cancel your subscription before it takes effect without penalty. Continuing to use the service after a change takes effect means you accept the updated terms.
If a dispute arises under these terms, before starting court proceedings (other than to seek urgent injunctive relief) each party must first give the other written notice of the dispute and attempt to resolve it in good faith through discussion between senior representatives, for at least 14 days.
We may assign, novate or transfer our rights and obligations under these terms, including as part of a sale or restructure of our business. You must not assign or transfer your rights under these terms without our prior written consent.
These terms are governed by the laws of Victoria, Australia. You submit to the exclusive jurisdiction of the courts of Victoria and courts competent to hear appeals from those courts.
If any part of these terms is found to be void, illegal or unenforceable, that part is severed and the remaining terms continue in full force. These terms (including the Privacy Policy incorporated into them) are the entire agreement between us about the service and replace any prior discussions or agreements about it. A failure or delay by either party to exercise a right under these terms is not a waiver of that right. Notices to you may be sent to the email address on your account; notices to us should be sent to support@safetycheckpro.com.au.
